1. Introduction

These Terms and Conditions ("Terms") govern your use of the KashmirWithUs website and your booking of any tour package, hotel, transport, or travel-related service offered by KashmirWithUs ("we", "us", "our", "the Company"). By accessing our website or making a booking, you agree to be bound by these Terms.

2. About Our Services

KashmirWithUs is a travel and tourism service provider offering tour packages, hotel and houseboat bookings, local transport, sightseeing tours, trekking and adventure activities, and related travel services across Jammu and Kashmir.

3. Booking & Payment

• A booking is considered confirmed only after receipt of the required advance payment and a confirmation message/email from KashmirWithUs.
• Full payment details, including advance amount and balance payment schedule, will be communicated at the time of booking.
• All payments must be made through the modes specified by KashmirWithUs (bank transfer, UPI, payment gateway, etc.).
• Prices quoted are based on current rates and may change due to fluctuations in fuel prices, hotel tariffs, government taxes, or permit fees, especially for bookings made well in advance of the travel date.

4. Cancellation & Refunds

For full details on cancellation slabs, refund timelines, and applicable charges for cancellations made within 10 days of travel, please refer to our Cancellation Policy page, which forms a part of these Terms.

5. Traveler Responsibilities

• Travelers must carry valid government-issued photo identification (Aadhar Card, Passport, Voter ID, etc.) for hotel check-ins and permit applications.
• It is the traveler's responsibility to ensure they meet health, fitness, and age requirements for adventure activities such as trekking, skiing, or gondola rides.
• Travelers must abide by local laws, customs, and instructions given by guides, drivers, and hotel staff during the trip.
• Any damage caused to hotel property, vehicles, or equipment due to traveler negligence will be chargeable to the traveler.

6. Permits & Documentation

Certain destinations within Jammu and Kashmir (such as Gulmarg, Sonmarg, and other restricted/protected areas) require special permits. KashmirWithUs will assist in arranging these permits; however, the issuance of permits is subject to approval by local government/military authorities and is beyond our control. We are not liable for denial of permits due to security, weather, or administrative reasons.

7. Changes to Itinerary

While we strive to operate all tours as per the confirmed itinerary, certain changes may be necessary due to weather conditions, road closures, political situations, strikes, natural calamities, or other circumstances beyond our control. In such cases, KashmirWithUs will make reasonable efforts to provide suitable alternatives, and any additional cost or refund (if applicable) will be communicated to the traveler.

8. Limitation of Liability

• KashmirWithUs acts as a facilitator between travelers and service providers (hotels, transporters, activity operators). We are not liable for any loss, injury, illness, death, delay, or damage caused by third-party service providers, force majeure events, or circumstances beyond our reasonable control.
• We strongly recommend travelers purchase travel/health insurance before undertaking any trip, especially for trekking and adventure activities.
• Our liability, in any case, shall not exceed the total amount paid by the traveler for the specific booking in question.

9. Use of Website

• All content on this website, including images, text, and logos, is the property of KashmirWithUs and may not be copied or reproduced without permission.
• You agree not to misuse the website for fraudulent bookings, spamming, or any unlawful activity.

10. Privacy

Your use of our website and services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.

11. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms or your booking shall be subject to the exclusive jurisdiction of the courts at Baramulla, Jammu and Kashmir.

12. Changes to These Terms

KashmirWithUs reserves the right to update or modify these Terms and Conditions at any time without prior notice. Continued use of our website or services after such changes constitutes acceptance of the revised Terms.
